1. Who we are and what these terms cover
CALA is an online platform operated by SOLYSIA ENERGY S.L.U. ("CALA", "we"), Son Prohens, Primera Volta, 110, 07200 Felanitx (Illes Balears), CIF B16610438. These Terms govern your use of the platform at cala.market. By creating an account or using CALA, you accept these Terms.
2. The service
CALA lets registered users publish and discover listings for preowned goods in southeast Mallorca. The service is currently provided free of charge. We do not charge listing fees and we take no commission or share of any transaction between users.
3. CALA is a platform, not a party to your transactions
This is important. CALA only provides the platform that connects users. We are not the seller or buyer of any item, we are not a party to any agreement between users, and we do not inspect, verify, guarantee, or take responsibility for any listing, item, user, or transaction. Any purchase, sale, exchange, payment, and delivery is arranged directly between users, at their own risk and responsibility. We strongly recommend that users meet in safe public places and verify items before paying.
4. Eligibility and your account
You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use CALA. You are responsible for keeping your account secure and for all activity under it. You must provide accurate information and keep it up to date.
5. Your listings and content
You are solely responsible for the listings and content you publish. By publishing, you confirm that:
- you own the item or are otherwise entitled to sell or offer it;
- your listing is accurate and not misleading;
- your content does not infringe anyone's rights or break any law.
You grant CALA a non-exclusive, royalty-free licence to host, display, and distribute your content on the platform for the purpose of operating the service.
6. Prohibited items and conduct
You may not list or trade, among others: illegal goods or services; weapons, ammunition, or explosives; drugs or regulated substances; stolen, counterfeit, or fraudulent goods; hazardous materials; live animals; human remains or bodily materials; adult or sexual content; or any item whose sale is restricted or prohibited by law. You may not: post false, misleading, or fraudulent content; harass, threaten, or abuse other users; spam; scrape or misuse the platform; or attempt to circumvent its security.
7. Messaging
Messages between users must remain lawful and respectful. We may access messages where necessary to investigate reported abuse, comply with law, or protect users and the platform.
8. Suspension and termination
We may suspend or remove listings, or suspend or terminate accounts, that breach these Terms or harm the platform or its users. You may close your account at any time.
9. Disclaimers and liability
The platform is provided "as is" and "as available." To the fullest extent permitted by law, we exclude liability for the conduct of users, the quality, safety, legality, or accuracy of listings, and any loss arising from transactions between users. Nothing in these Terms limits liability that cannot be limited under applicable law, including consumers' statutory rights.
10. Indemnity
You agree to hold CALA harmless from claims arising out of your listings, your transactions with other users, or your breach of these Terms, to the extent permitted by law.
11. Changes
We may update these Terms. We will post the updated version with a revised date and, where significant, notify you. Continued use after changes means you accept them.
12. Governing law
These Terms are governed by Spanish law. Disputes are subject to the courts of Felanitx, without prejudice to mandatory consumer protections allowing consumers to sue in their place of residence.
